THE HUNDRED AVATARS COMPETITION 2021 TERMS AND CONDITIONS

Competition Overview

  1. England and Wales Cricket Board Limited (company number 03251364), whose registered office is at Lords Cricket Ground, St Johns Wood, London, NW8 8QZ (“ECB”) is running a prize draw to give cricket fans the chance to win a pair of ground admission tickets to The Hundred Final currently scheduled to take place on Saturday 21 August 2021 at Lord’s (the “Competition”).
  2. Each individual who validly enters the Competition in accordance with these Competition Terms and Conditions (each an “Entrant”) is deemed to have accepted, and agreed to be bound by, these Competition Terms and Conditions upon entry into the Competition.
  3. The decision of the ECB regarding any aspect of the Competition is final and binding (including as to the award of the prizes) and no correspondence will be entered into by the ECB in relation to the Competition.

Entry Process

  1. The Competition will be open for entry between 1:00pm Thursday 12 August 2021 (“Start Date”) and 11:59pm on Wednesday 18 August 2021 (“End Date”). Entries received outside of this period will not be valid and will not be included in the Competition.
  2. To enter the Competition, Entrants must follow The Hundred on Instagram and post a photo or video of themselves, friends and/or family using and/or playing with The Hundred player avatars within The Hundred app to their Instagram feed and use #thehundredavatars. All entries must be made between the Start Date and the End Date. Entries will not be accepted by any other means.
  3. Entrants acknowledge that the ECB may onward post entries submitted in accordance with the Competition on its social media channels, and Entrants confirm that they have obtained permission from all individuals featured in the entry to post it (and for the ECB to onward post it on its social media channels) and made them aware of how their personal data will be used by the ECB (and where an individual is under 18, they have obtained permission from the individual’s parent/carer). In addition, Entrants confirm that their entry is an original work, not obscene, disparaging, critical of any person, offensive, likely to infringe the rights of any third party, or is otherwise unlawful. The ECB reserves all rights to disqualify from the Competition any entries which contravene, or are found to contravene, any of the criteria set out in this clause, or are deemed by the ECB to be critical of the ECB, or are deemed ineligible by the ECB for any other reason (including where the Entrant’s conduct is contrary to the spirit or intention of the Competition).
  4. The Competition is free to enter. No purchase is necessary.

Eligibility

  1. Entrants must be aged 18 or over and resident in England or Wales
  2. No employees of the ECB (or members of their families) involved in the administration of the Competition may win the Competition.
  3. By entering the Competition, Entrants confirm that they are eligible to do so and eligible to claim the prize that they may win. The ECB may require an Entrant to provide proof that they are eligible to enter the Competition.
  4. There is a limit of one entry to the Competition per person. Entrants' use of Instagram is subject to Instagram’s terms and conditions of service.
  5. The ECB reserves the right to disqualify any Entrant if it has reasonable grounds to believe that the Entrant has breached these Competition Terms and Conditions.
  6. The ECB accepts no responsibility for Competition entries that are not successfully completed, regardless of cause, including (without limitation) due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure, of any kind.

Prize

  1. There will be one winner of the Competition (the “Winner”): the prize for the Winner is a pair of ground admission tickets to The Hundred Final currently scheduled to take place on Saturday 21 August 2021 at Lord’s.
  2. The Winner will be drawn at random (from all valid entries received by the ECB) using a computer-generated selection process within 24 hours of the End Date.
  3. The odds of winning will depend on the total number of valid entries received.
  4. The prize is non-exchangeable, non-transferable and no cash alternative is offered. The prize does not include anything not expressly set out in these Competition Terms and Conditions, including spending money, food and drink, associated travel and accommodation, medical or other general expenses. The prize is subject to availability and the ECB reserves the right, in its sole discretion, to substitute the Winner’s prize for an alternative prize, if necessary. Ground entry is not guaranteed and is subject to such health, safety and security rules and regulations which may be in place from time to time, including without limitation in relation to COVID-19 or any associated public health emergency. The prize is subject to the relevant terms and conditions attaching to such tickets and the relevant conditions of entry.

Claiming the prize

  1. The Winner will be contacted by the ECB as soon as reasonably practicable after the draw by sending a direct message to the Instagram account used to submit the entry.
  2. The Winner must claim their prize, by responding to the ECB, within 24 hours of being notified by the ECB that they have won the prize. Only the Winner will be notified.
  3. The ECB reserves the right, in its sole discretion, to offer the prize to another Entrant where the Winner:

(a) fails to claim their prize within the prescribed timeframe;
(b) fails to meet the eligibility requirements set out in these Competition Terms and Conditions; 
(c) is unable or does not want to accept the prize that they have won for any reason; or
(d) the ECB determines that the relevant Winner has breached these Competition Terms and Conditions.

  1. The ECB does not accept any responsibility for failure by the Winner to claim their prize.

Limitation of Liability

  1. Neither the ECB nor any of its partners, affiliates, agents, employees, officers, directors or representatives will be liable (to the fullest extent permitted by law) for any direct, indirect or consequential loss or damage arising out of the organising or holding of the Competition or as a result of any Entrant’s participation in the Competition or as a result of winning, collecting, use or enjoyment of the prize, Competition does not run as planned or if the prize (or any part of the prize) is unable to be delivered for any reason. Entrants’ statutory rights are not affected.
  2. If the Competition, or any part of it, is not capable of running or being completed as planned for any reason, including but not limited to reasons of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the ECB, the ECB reserves the right to cancel, terminate, modify or suspend the Competition without liability.
  3. The ECB accepts no responsibility for Competition entries that are not successfully completed or submitted, regardless of cause, including (without limitation) due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure, of any kind.

Entrants’ Personal Data

  1. Any personal data relating to any individual which is received by the ECB in relation to the Competition will be used in accordance with applicable UK data protection legislation, the ECB’s The Hundred Privacy Notice which can be found here, and the ECB’s Privacy Policy which can be found at ecb.co.uk/privacy or by clicking here.
  2. The ECB must either publish or make available information that indicates that a valid award took place. To comply with this obligation, details of the Winner (name and county) will be made available to anyone who emails feedback@ecb.co.uk within one month of the Closing Date. If an Entrant objects to any of their details being published or made available in accordance with this clause, please contact the ECB at feedback@ecb.co.uk. In such circumstances, the ECB must still provide the information to the Advertising Standards Authority, on request.
  3. If an Entrant has any questions about these terms and conditions, including any request to exercise their legal rights under data protection law, they should contact the ECB at privacy@ecb.co.uk.
  4. All Entrants agree that if they are the Winner they will take part in any promotional activity reasonably requested by the ECB in relation to the Competition.

General

  1. The ECB reserves the right to refuse Entry to the Competition, to disqualify from the Competition or to refuse to award the prize to anyone who it reasonably considers has breached these Competition Terms and Conditions or to anyone who, in the ECB’s sole opinion, has otherwise acted improperly or dishonestly.
  2. The ECB reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
  3. If any provision of these Competition Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Competition Terms and Conditions, which shall remain in full force and effect.
  4. These Competition Terms and Condition (and any non-contractual obligations arising out of or in connection with them) will be governed by and construed in accordance with English law and all Entrants submit to the exclusive jurisdiction of the English courts in relation to any dispute or claims arising out of, or in connection with, these Competition Terms and Conditions or relating to the Competition.
